Introduction

  1. These Terms set out the legally binding terms which apply to everyone who accesses or uses the website at www.lammafisherfolks.com ("Website"). Please read the Terms carefully before using this Website. By accessing or using this Website, you agree to be bound by these Terms. If you do not wish to be bound by these Terms, you must leave this Website immediately.
  2. This Website is owned and operated by Lamma Fisherfolk’s Village Limited (a company registered in Hong Kong SAR, whose registered office is at 2/F, 20 Sok Kwu Wan First Street, Sok Kwu Wan, Lamma Island, Hong Kong). ("Lamma Fisherfolks Village", "LFV", "we", "us", "our"), for and on behalf of itself.

B. Ticket Purchase Terms

Online ticket purchases

  1. There are no rights of refund or exchange.
  2. The FAQs contain details of how to place your order for an entrance ticket, including how to correct input errors during the ordering process. We advise you to read these FAQs before you proceed to place an order for a ticket.
  3. The Prices of the tickets are those displayed on the Website from time to time, during the ordering process, except in cases of obvious error. All prices are in Hong Kong Dollars. Remote payment can be made by any method specified in the FAQs. You cannot use any promotional vouchers or discount cards in conjunction with a ticket purchase via this Website (if you wish to do this, you will need to visit our ticket office in person). You cannot use guest passes to pay for a ticket purchase via this Website (if you wish to do this, you will need to visit our ticket office in person or phone the booking number on the back of the guest pass). If you are a student, you can still benefit from the student price, but you must bring your proof of student identity to the our ticket office when you collect your tickets (see the FAQs for details of the type of proof we accept).
  4. When you purchase a ticket via this Website, all transaction details that you provide to Paypal Ltd (including your name and credit card details) will be held and used in accordance with our Privacy and Cookie Policy and will be encrypted using SSL (secure sockets layer) technology. Paypal Ltd will take reasonable steps to safeguard transaction details, but you acknowledge and agree that the use of Internet booking can never be completely secure. Subject to paragraph 3 ("Your statutory rights"), unless either Paypal Ltd or LAmma Fisherfolk’s Village has been negligent, Paypal Ltd or LAmma Fisherfolk’s Village shall not be liable for any loss or damage you may suffer as a result of the loss of confidential or personal information provided to Paypal Ltd via this Website.
  5. Tickets can be collected from our ticket office in Sok Kwu Wan when your credit/debit card transaction and the entire ordering process has been completed. For security reasons, the cardholder must be present to collect the tickets, and you will need to take the same card as you have used to make your booking.
  6. You represent and warrant that any tickets you purchase are for personal use only, and that they are not purchased as part of any form of for profit business or commercial activity, unless we have expressly authorised otherwise in writing.
  7. You undertake that you will not resell or offer for resale any tickets (whether at a premium or otherwise) or use tickets for advertising or promotions (including prize draws, competitions, contests and/or sweepstakes) or for any other trade purposes. If you resell or offer for resale any tickets, then they will be invalid.
  8. It is your responsibility to check your tickets as we are under no obligation to rectify mistakes after a contract has been formed. Please also note that we are not under an obligation to provide the ticket(s) to you at the incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you, if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
  9. Seating will be unreserved unless otherwise specified expressly during the ordering process.
  10. We will not be responsible for any tickets that are lost or stolen.
  11. We accept no responsibility for any personal property that is brought to our village.
  12. Price and availability information is subject to change without notice.
  13. Unless otherwise expressly stated on this Website, tickets cannot be exchanged or refunded.

Non-compliance with these Terms

  1. We reserve the right to investigate any suspected non-compliance with these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this Website or take such other corrective action as we deem appropriate.

Limitations on Lamma Fisherfolk's Village Limited liability to you

  1. We will use reasonable endeavours to ensure the accuracy of any information on this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be accurate, current, complete, or error-free. Unless we have been negligent, we accept no liability of any kind for any loss or damage arising from action taken in reliance on information on this Website.
  2. We will use reasonable endeavours to exclude computer viruses from this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be free from computer viruses introduced by third parties. Unless we have been negligent, we accept no liability of any kind for any loss or damage caused by computer viruses.
  3. Subject to paragraphs 3 ("Your statutory rights"), in the event that you purchase any products online via this Website, our liability (whether in contract, tort (including negligence), statute or otherwise) arising out of or in connection with the purchase of those tickets shall be limited to the price paid by you for those products.
  4. Subject to paragraph 3 ("Your statutory rights"), we will not be liable to you for any:
    1. loss of profits;
    2. loss of revenue;
    3. loss of anticipated savings;
    4. loss of business;
    5. loss of opportunity;
    6. loss of data;
    7. loss of or damage to goodwill or reputation; or
    8. any indirect or consequential loss or damage,

whether arising under contract, tort (including negligence), statute or otherwise.

Events outside our control

  1. We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations that are caused by events outside our reasonable control.

 

Jurisdictional issues

  1. This Website is directed only at users in the Hong Kong SAR and you may only use this Website to purchase tickets if you are domiciled in the Hong Kong SAR. If you access this Website from outside Hong Kong SAR, you do so at your own initiative and risk, and you are responsible for compliance with any applicable local laws.
  2. These Terms and your access to or use of this Website are governed by the relevant law listed below, and any dispute arising in connection with this Website shall be subject to the non-exclusive jurisdiction of the relevant court listed below:
    1. for users in the Hong Kong SAR, the law and courts of the relevant part of the Hong Kong SAR;

Changes to the Terms

  1. Notwithstanding anything to the contrary, we reserve the right to amend these Terms from time to time without notice. Amendments will take effect when posted on this Website, when made by us. Please check this Website and (in particular), this page regularly for changes or information about changes. If you access or use this Website after any amendment to these Terms has taken effect, you hereby agree to be bound by the updated version of these Terms.

Prize draws and competitions

  1. By entering an Lamma Fisherfolk’s Village prize draw or competition, unless specific prize draw or competition terms are set out in conjunction with the details of that prize draw or competition (in which case the prize draw or competition will be governed by such terms), you agree to be bound by the terms and conditions set out below:
    1. To enter a Lamma Fisherfolk’s Village prize draw or competition, without purchasing a entrance ticket, please send your entry along with a prize draw application form to the Lamma Fisherfolk’s Village, 2/F 20 Sok Kwu Wan First Street, Sok Kwu Wan, Lamma Island, Hong Kong . We will then place your entry into the draw;
    2. Winners will be contacted by an appropriate method within 28 days of the notified closing date;
    3. All prizes are non-transferable;
    4. Judge's decision is final. No correspondence will be entered into;
    5. No cash alternative. The promoter reserves the right to substitute prizes with goods of an equal or greater value in the unlikely event that these exact prizes become unavailable;
    6. No trade, consumer groups or 3rd party applications acceptable;
    7. The promoter reserves the right to disqualify incomplete, altered or illegible entries;
    8. The promoter is Lamma Fisherfolk’s Village Limited.
    9. The competition/prize draw is governed by the law of Hong Kong SAR.
